Admiral Uniforms ("Company") markets and sells products under the brand name KEMET through its website wearkemet.com. These Terms govern all access to and use of the Website, including browsing, placing orders, making payments, and all related interactions. By accessing this Website or placing an order, you are legally bound by these Terms.

This document is formulated in compliance with the Indian Contract Act, 1872; the Consumer Protection Act, 2019; the Consumer Protection (E-Commerce) Rules, 2020; the Information Technology Act, 2000; the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; and the Digital Personal Data Protection Act, 2023.

1. Definitions

  • Company — Admiral Uniforms, operating the KEMET brand at wearkemet.com.
  • User / Customer — Any individual who accesses the Website, places an order, creates an account, or otherwise engages with our services.
  • Website — wearkemet.com, including all pages, subdomains, and interfaces operated by the Company.
  • Products / Goods — All medical scrubwear, apparel, and merchandise listed and sold via the Website.
  • Account — A registered user profile on the Website storing contact details, order history, and preferences.
  • Personalised Order — Any order that includes custom embroidery, name printing, logo application, or any other personalisation applied to a garment.
  • Policies — Collectively, the Refund & Exchange Policy, Privacy Policy, Shipping Policy, and any other published policy documents of the Company.
  • Grievance Officer — The designated person appointed by the Company to handle user complaints and disputes.
  • Force Majeure — Any event beyond the Company's reasonable control, including natural disasters, pandemics, government restrictions, strikes, or cyberattacks.
  • Applicable Law — Any statute, regulation, rule, or order enacted by a competent authority in India having the force of law.

2. Acceptance of Terms

By accessing the Website, creating an account, or placing an order, you confirm that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, please discontinue use of this Website immediately.

These Terms constitute a legally binding agreement between the User and Admiral Uniforms. Use of the Website or completion of any transaction constitutes full acceptance.


3. Eligibility

By using this Website, you represent and warrant that:

  • You are at least 18 years of age and legally competent to enter into a binding contract under Section 11 of the Indian Contract Act, 1872.
  • You are of sound mind and not disqualified from contracting by any applicable law.

In compliance with the Digital Personal Data Protection Act, 2023, the Company does not knowingly collect data from or contract with minors. The Company reserves the right to restrict or terminate access to any User found to be in violation of this clause.


4. User Account

To access certain features including placing orders, tracking shipments, and saving addresses. Users may be required to register for an Account. By creating an Account, you agree to:

  • Provide accurate, complete, and current information at all times.
  • Maintain the confidentiality and security of your login credentials, OTP codes, and linked contact details.
  • Notify the Company immediately at wearkemet@gmail.com if you suspect any unauthorised use of your Account.

Each Account is personal and non-transferable. The Company reserves the right to suspend or terminate any Account involved in fraudulent activity, policy violations, or misuse of the platform. Accounts inactive for 24 or more consecutive months may be deactivated after 30 days' notice to the registered email address.


5. Acceptable Use

By using the Website, you agree to use the platform for lawful purposes only. The following are strictly prohibited:

  • Accessing or using the Website in violation of any applicable Indian law.
  • Uploading or transmitting any content that is defamatory, abusive, obscene, or otherwise unlawful.
  • Infringing any intellectual property rights of the Company or any third party.
  • Attempting unauthorised access to the Website, its servers, databases, or connected systems.

  • Creating multiple accounts to abuse discounts, promotions, or platform features.
  • Posting fake reviews, falsifying transaction data, or manipulating any feedback mechanism.
  • Impersonating any person or entity, including Company employees.

The Company reserves the right to suspend or terminate access, remove content, and initiate legal proceedings against any User found in violation of this clause.


6. Product Information & Listings

The Company makes every reasonable effort to ensure all products are accurately described on the Website, including name, specifications, available sizes, colour options, fabric composition, and pricing.

  • Minor variations in colour or texture may occur due to display settings, lighting, or manufacturing tolerances and shall not constitute a defect.
  • All product images are for illustrative purposes only. Actual products may differ slightly in appearance.
  • Product availability is subject to stock levels. The Company reserves the right to modify or withdraw listings without prior notice.
  • In the event of a pricing error, the Company reserves the right to cancel the affected order and issue a full refund.

7. Pricing & Payment

All prices are displayed in Indian Rupees (₹) and are inclusive of applicable GST unless stated otherwise. The Company reserves the right to revise pricing at any time; confirmed and paid orders will not be affected by such revisions.

Payment must be made in full at the time of placing an order. All transactions are processed through secure, RBI-compliant payment gateways using SSL encryption. KEMET does not store payment credentials.


8. Orders & Order Confirmation

Placing an order constitutes an offer to purchase not final acceptance. An order is deemed accepted only upon:

  • Successful payment authorisation and internal verification.
  • Packaging and handover to the logistics partner.
  • Dispatch of a shipping confirmation email with a tracking ID.

The Company reserves the right to cancel or modify any order in cases of stock unavailability, payment failure, address validation issues, pricing errors, or suspected fraudulent activity. A full refund will be initiated to the original payment method in all such cases.


9. Personalisation Orders

Orders that include personalisation (embroidery, name printing, or logo application) are subject to the following conditions:

  • Personalised orders are non-cancellable once confirmed.
  • They are not eligible for return or exchange, except in the case of a verified manufacturing defect or an error made by the Company.
  • Cash on Delivery (COD) is not available for personalised orders.
  • Personalisation charges (embroidery, customisation) are non-refundable under any circumstances.

10. Cancellations

By the Customer

Standard (non-personalised) orders may be cancelled within 12 hours of placement, provided the order has not yet been dispatched. To request a cancellation, email wearkemet@gmail.com with your Order ID. Once dispatched, the Refund & Exchange Policy applies.

By the Company

The Company reserves the right to cancel any order under the following circumstances:

  • Product is out of stock or discontinued.
  • Payment authorisation fails or remains unconfirmed.
  • The order is flagged for suspicious activity or policy violations.
  • Delivery is not serviceable to the provided address.
  • There is a pricing or listing error.

In all such cases, the User will be notified and a full refund will be initiated to the original payment method within 7–10 business days.


11. Returns, Exchanges & Refunds

Complete details are set out in the Refund & Exchange Policy, incorporated into these Terms by reference and available at wearkemet.com. In summary:

  • Exchange requests must be raised within 7 days of confirmed delivery.
  • Eligible reasons: size mismatch, manufacturing defect, or wrong item received.
  • Products must be unused, unwashed, and returned with all original tags and packaging intact.
  • Refunds are issued to the original payment method only in specific cases no store credits or cash alternatives.
  • Products purchased during clearance events or marked "Final Sale" are not eligible for return or exchange.

12. Shipping & Delivery

The Company partners with third-party logistics providers for domestic delivery. Estimated delivery timelines are indicative and may vary based on location, stock availability, and courier performance.

  • Once dispatched, risk and responsibility for the shipment transfers to the logistics provider.
  • The Company is not liable for delays caused by courier inefficiencies, natural calamities, public holidays, or force majeure events.
  • If an order is undeliverable due to an incorrect address or customer unavailability, original shipping charges are non-refundable and re-dispatch will be at the Customer's cost.

13. Intellectual Property

All intellectual property on this Website including the KEMET name, logo, brand identity, SKU names, product images, website design, text, and software is the exclusive property of Admiral Uniforms and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.

Users may not copy, reproduce, modify, distribute, or commercially exploit any content from this Website without the prior written consent of the Company. Any unauthorised use constitutes a material breach of these Terms and may result in civil and/or criminal liability.


14. User Content & Reviews

Users may voluntarily submit reviews, ratings, or other content through the Website. By doing so, you:

  • Grant the Company a non-exclusive, royalty-free, worldwide license to use, display, or reproduce such content for marketing or operational purposes.
  • Confirm the content is original, lawful, and does not infringe any third-party rights.
  • Acknowledge that the Company may remove content found to be abusive, fake, misleading, or in violation of these Terms.

15. Third-Party Links

The Website may contain links to third-party websites for convenience. KEMET does not endorse, control, or take responsibility for the content, privacy practices, or policies of any third-party site. Accessing such sites is at your own risk.


16. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of this Website, reliance on product descriptions, delays in delivery, or inability to access services.

The Company's total liability for any direct damages shall not exceed the amount actually paid by the User for the relevant order.


17. Indemnity

You agree to indemnify and hold harmless Admiral Uniforms, its directors, employees, and agents from any claims, losses, liabilities, damages, or costs (including legal fees) arising from:

  • Breach of these Terms or any Company policy.
  • Content submitted by you that violates third-party rights or applicable law.
  • Any fraud, misrepresentation, or unlawful conduct by you on the platform.

This obligation survives termination of these Terms.


18. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Rules, 2021, the Company has appointed a Grievance Officer to handle complaints related to orders, returns, platform usage, or personal data.

19. Privacy & Data Protection

Users have the right to access, correct, withdraw consent, and request deletion of their personal data as detailed in the Privacy Policy.


20. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ludhiana, Punjab, India.

Nothing in these Terms limits a consumer's statutory rights under the Consumer Protection Act, 2019.


21. Modifications to Terms

The Company reserves the right to update or modify these Terms at any time without prior notice. Changes take effect immediately upon posting to the Website. Continued use of the Website after any changes constitutes acceptance of the revised Terms.


22. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed and the remaining Terms shall continue in full force and effect.


23. Entire Agreement

These Terms, together with the Privacy Policy, Refund & Exchange Policy, and Shipping Policy, constitute the entire agreement between the User and the Company with respect to the Website and supersede all prior communications or understandings.
